So how is it that we have the concept of public access to our nations waterways? Public access to the water is provided for in legal documentation that is referred to as the Public Trust Doctrine. The Public Trust Doctrine consists of common law and constitutional principals, which establish basic public and private rights in surface waters, including the rights of ownership, access and use. These rights have evolved over time and in face, has its origin in English Common Law, which in part states that the Crown held tidal waters in trust for the public and that all other waters were private.
